At Avalos Wholeness Group, we are dedicated to providing a supportive and transformative space for healing, growth, and alignment. However, it’s important to clarify that our services are for informational and educational purposes only and are not a substitute for professional medical, psychological, or financial advice.


Medical Disclaimer

We are not licensed medical doctors, psychologists, therapists, or healthcare professionals; we do not prescribe medications or advise to remove any prescription medication, and we do not diagnose, treat, cure, or prevent any medical or psychological conditions. Our services are for informational and educational purposes only and are not professional training nor are they to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is Client’s exclusive responsibility to seek such independent professional guidance as needed.  


Company is not a registered dietician. Client agrees that Company is not and will not be liable or responsible for any allergic reactions or other injury as a result of Client’s participation of Company’s Services. Client agrees to observe and obey all instructions and warnings given by Company. The use of Company’s information, products and services should be based on Client’s due diligence. By participating in Services, Client recognizes that there are certain inherent risks in the activities and assumes full responsibility for any personal injury. Company disclaims any liability for economic loss, physical injury or illness. Client agrees that Company is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any Services.


If you are currently under the care of a medical or mental health professional, or have any pre-existing conditions, we ask that you disclose this before participating in any 1:1 sessions, group programs or workshops. Additionally, we encourage you to inform your provider of your participation. By engaging with our services, you acknowledge that you are responsible for your own well-being and decisions.


RELEASE OF LIABILITY AND ASSUMPTION OF RISK.
 

By registering for, participating in, and attending the session you acknowledge and agree that your attendance and participation are entirely voluntary, and you understand the nature of the  session. You acknowledge that the session may involve physical activities, spiritual practices, hands-on healing practices, and healing or personal growth sessions in multiple modalities. You voluntarily choose to participate in these activities and assume all associated risks. To the fullest extent allowed by law, you accept personal responsibility for any reactions, outcomes, or results from your participation, regardless of any actions or omissions by the company or other parties. You hereby expressly waive and release any and all claims, now known or hereafter known, against the company and its officers, directors, managers, employees, agents, affiliates, shareholders/members, successors, and assigns (collectively, "releasees"), on account of any injury, disability, death, or property damage arising out of or attributable to your participation in the workshop and sessions. You covenant not to make or bring any such claim against the company or any other releasee and forever release and discharge the company and all other releasees from liability under such claims.


Earnings & Results Disclaimer

Individual results vary based on many factors, including personal effort, background, and circumstances. We do not guarantee any specific outcomes—whether emotional, financial, or professional—as a result of participating in our services. Any testimonials or past results shared are not guarantees of future success.


PHOTOGRAPHY AND VIDEOGRAPHY RELEASE. 



Workshops will be filmed and recorded. Private 1:1 sessions will not. We will notify participants during the event when filming or photography is to occur. No personal information or results from the workshop will be shared. If you do not wish for your image, video, voice, or likeness to be used, it is your responsibility to notify us at that time. By participating in and attending the Workshop, you grant the Company, its affiliates, successors, assigns, and independent contractors full and exclusive ownership of all images, videos, and voice recordings captured during the event, including but not limited to photographs, still and moving footage, and behind-the-scenes content (collectively, “the Images”). As the sole owner of the Images, the Company has the unrestricted right to use, reproduce, modify, distribute, translate, publicly display, create derivative works from, and otherwise use the Images in any manner and in any media now known or hereafter devised, in perpetuity and worldwide. This includes, but is not limited to, use for advertising, promotional, marketing, trade, editorial, exhibition, and commercial purposes. The Company may edit the Images, combine them with other content, use them alone or in connection with other materials, and allow others to use and disseminate them. The Company may also use artificial intelligence or other technologies to modify, enhance, or transform the Images. To the maximum extent permitted by law, you waive any and all rights you may have in the Images, including but not limited to rights of publicity, privacy, approval, royalties, or other compensation. You also waive any right to inspect or approve any use of the Images. You agree not to interfere in any manner with the development, production, distribution, exhibition, advertising, or promotion of the Images. You acknowledge and agree that participation in the photography, production, or filming of the event may involve certain risks, including but not limited to personal injury. You hereby release and discharge the Company, its affiliates, and related entities, including but not limited to current and former employees, officers, directors, shareholders, partners, members, managers, agents, attorneys, successors, and assigns (“The Released Parties”), from any and all claims, actions, damages, demands, causes of action, debts, liabilities, controversies, judgments, and suits of every kind and nature whatsoever, foreseen, unforeseen, known or unknown, that arise out of or relate to the use of the Images or any personal injury sustained during the photography, production, or filming of the event. To maintain a safe and focused environment, no photography or videography by participants is permitted during group coaching sessions or the Workshop.


COMPANY CONFIDENTIALITY. 

Company agrees not to disclose any information pertaining to Client without Client’s written consent, with the exception of the information described herein. Confidential Information does not include information that: (a) was in Company’s possession prior to its being furnished by Client; (b) is generally known to the public; (c) is obtained by Company from a third party, without breach of any obligation owed to Client; (d) is independently developed by Company without use of or reference to Client’s Confidential Information; (e) the Company is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the Company and as a result of such disclosure Company reasonably believes there to be an imminent or likely risk of danger or harm to Client or others; or (g) involves illegal activity. Client should also be aware that telephone, email and videoconference are not encrypted methods of communication, and some confidentiality risk exists with their use. Client must raise any confidentiality questions or concerns with the Company in a timely manner.


STUDENT CONFIDENTIALITY. 

During the course of your session and the workshop you may receive, have access to and create documents, records and information of a confidential and proprietary nature to the Company. This confidential information may include but is not limited to Company work product, curriculum materials, trackers, intake forms, charts, graphics, Company and member financial information, marketing plans and strategies, market research, Student and other mailing lists, business transactions, supplier or vendor relationships, contract terms, present and future projects and products, and pricing and cost information, and other information that is not generally known to the public (“Confidential Information”). You acknowledge and agree that such Confidential Information is an asset of the Company, is not generally known to the trade, is of a confidential nature and, to preserve the goodwill of the Company and must be kept strictly confidential and used only in the performance of the Services. You agree that you will not use, disclose, communicate, copy or permit the use or disclosure of any such information to any third party in any manner whatsoever except as otherwise directed by Company and only with the written permission of the Company. You shall notify the Company immediately in the event you become aware of any loss or disclosure of any Confidential Information. Upon termination of these Terms or upon the request of Company, you will return to Institute all of the Confidential Information, and all copies or reproductions thereof, which are in your possession or control. You also acknowledge your continuing obligation to raise any confidentiality questions or concerns with the Company in a timely manner.


MEDICAL TREATMENT.

By participating in any in-person session, workshop, or the Event organized by the Company, Client consents to receiving medical treatment provided by a healthcare professional if deemed necessary in the event of injury or illness during the in-person sessions, workshop or Event. It is Client’s responsibility to inform Company of any pre-existing medical conditions, injuries, or other health concerns prior to or during the in-person sessions, workshop or Event. In the event of injury or medical emergency, the Company may contact medical professionals or request medical assistance on Client’s behalf, but the Company is not responsible for providing medical treatment or acting as a substitute for professional medical care. Client understands and agrees that they are solely responsible for all costs associated with medical treatment, including any transportation or evacuation services required. Client hereby releases the Company from any liability, claims, or actions related to the provision of medical treatment or emergency services. You hereby release, forever discharge, and hold harmless the Company from any claim based on such treatment or other medical services. We accept no responsibility for any illness or personal injury.


ALCOHOL DISCLAIMER.
 
No alcohol will be provided during the programming. If you choose to consume alcoholic beverages or other recreational substances anytime within 24 hours of the  session including during the session, you do so at your own risk and your participation in the  session will be removed.

ALLERGY DISCLAIMER.

If Company chooses to provide snacks and meals during the session, any attendees with food allergies must make Company, and any applicable third party preparing or serving any food, aware of any allergens and the severity of them. Company is not a certified nutritionist or registered dietician. You agree that Company is not and will not be liable or responsible for any allergic reactions or other injury as a result of your participation and attendance at the session.


Non-Disparagement

We are committed to fostering a safe, supportive space. By engaging with our offerings, you agree to communicate with mutual respect and integrity. This includes refraining from making false, misleading, or disparaging statements about Avalos Wholeness Group, its facilitators, or fellow participants, both during and after your participation.


By proceeding with our offerings, you acknowledge that you have read and understood this disclaimer and assume full responsibility for your participation.


INTELLECTUAL PROPERTY RIGHTS. 


All content and features displayed at the Energy Lab Workshop, including but not limited to information, software, images, text, designs, graphics, video, audio, written materials, presentations and the arrangement thereof, are owned by the Company, its licensors or other providers of such material, and are protected by copyright, patent, trademark, trade secret and other intellectual property or proprietary rights laws.  The Company name, trademarks, the Company logo, and all related names, logos, product and service names, designs and slogans are trademarks of the Company or its licensors. You may not use such trademarks or other intellectual property belonging to the Company without the prior written consent of the Company. 


NO REPRODUCTION.


You may not reproduce, distribute, modify, create derivative works of, republish, transmit, sell, resell, teach, or exploit any of the material displayed at the Retreat or provided to attendees of the Energy Lab Workshop.


FORCE MAJEURE. 

We and our affiliates will not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control, including acts of God, labor disputes or other industrial disturbances, electrical or power outages, utilities or other telecommunication failures, earthquake, storms, or other elements of nature, blockages, embargoes, riots, acts or orders of government, acts of terrorism, or war. 


WARRANTIES DISCLAIMER. 


Client’s use of the Services or items obtained throughout Client’s participation in the Services is at Client’s own risk and are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
